This Privacy Policy applies to data and information collected by V5 from or about you when you (i) access V5 websites or use V5 applications (including mobile applications); (ii) order V5 products and services; or provide any personal information to access and/or review V5 newsletters or e-mails to or from V5. Some information may also be collected off-line, and this Notice applies to the off-line data collection as well.

What Personal and Other Information Does V5 Collect?

Generally, you may visit our websites without providing any personal information or identifying yourself. We only collect customer information via the "opt-in" method, where visitors or customers must affirmatively elect to provide V5 with their information.

If a visitor or customer elects to opt-in, V5 may collect personal information and other information from or about you, including but not limited to, when you: order products or services; register products or for an event; request information; subscribe to marketing or support materials; download or upload software updates or upgrades; enter a contest and respond to promotional sign-ups or campaigns. The type of information collected may include standard contact information such as your name, email address, postal address, telephone number, and technical or demographic information.

We also may collect information that is related to you but that does not personally identify you, such as your computer’s operating system, browser, and information regarding your use of and activities on our websites or applications.

How Does V5 Systems Use Your Information?

V5 strives to keep your information accurate and have implemented technology, management processes, and policies to maintain such data integrity. We may use this information to customize your website experience by delivering the content and information that we believe would be of interest to you. This information is also used to inform you of the latest V5 developments, including new product releases, upgrades, special offers and other relevant information.

We may collect, store and/or retain any personal or technical information relating to your use and operation of the Product(s), systems, Software, or other devices for purposes of facilitating the provision of proper functionalities, updates, upgrades, license authentication, Customer Support and analytics only to the extent necessary to provide you with the relevant services and Product or device functionalities as ordered (e.g., including, without limitation, health, power, performance and digital security monitoring), to identify and respond to any security threats, enable V5 to improve its Products and Services and to further or improve overall security for all users (collectively, “Data”).

The information we collect is intended for V5 business purposes only. In certain instances, we may make your information available to third parties that are providing services on our behalf. V5 will only provide those third parties with information that is necessary for them to perform the services and who have agreed to take measures to protect your information that are at least as stringent as the measures that we take ourselves. We may also disclose your information to our business partners, for marketing and other business purposes, and as a result we or our business partners may communicate with you from time to time via email, telephone or physical mail. If at any time you tell us that you no longer wish to receive certain communications, unsubscribe or choose not to receive promotional materials from V5 (or from specific divisions or subsidiaries) or request access to, or correction, deletion or removal of, your personal information please contact us at info@v5systems.us.

Portions of this website may make forums and message boards available to its visitors. ANY AND ALL INFORMATION THAT IS DISCLOSED IN THESE AREAS BECOMES PUBLIC INFORMATION AND V5 IS NOT OBLIGATED TO ENSURE THE PRIVACY OF THIS INFORMATION. PLEASE USE APPROPRIATE DISCRETION AND CAUTION WHEN DECIDING TO DISCLOSE ANY PERSONAL INFORMATION. Additionally, we do not have access to or control over the information posted on a third-party application. Collection of Information Using Cookies and Other Tools

V5’s websites utilize cookies (small amounts of data stored by your Web browser on your hard drive or mobile devices) to help enable us to offer you more personal and customized content and service. With Whom Does V5 Share Your Information?

V5 contracts with third-party service providers to deliver certain products, services, and customer solutions. V5 may share your information with its third-party service providers to the extent necessary to deliver the product or service you requested, respond to your requests for information on products or services, or otherwise support your business needs. Third-party service providers receiving information are expected to maintain privacy and security protections that are consistent with V5’s privacy and information security policies. These companies are authorized to use your information only for the business purposes for which it was originally intended or as required or permitted by law. V5’s websites may provide links to third-party websites for your convenience and information. If you access those links, you will leave the V5 website. V5 does not control these third-party websites or their privacy practices, which may differ from V5’s. We do not endorse or make any representations about third-party websites and V5 is not responsible for any improper use by such parties. The personal information you choose to provide to unrelated third parties is not covered by the V5 Privacy Policy. We encourage you to review the privacy policy of any entity before submitting your personal information.

We may also disclose any information about you in our possession, including across country borders: to our subsidiaries, affiliates, and worldwide offices; to comply with the law or in response to a subpoena, court order, law enforcement or government request, or other legal process; to produce relevant videos, audios, documents or information in connection with litigation, arbitration, mediation, adjudication, government or internal investigations, or other legal or administrative proceedings; if V5 determines in its good faith judgment that such disclosure is necessary to provide its services or to protect the rights, interests, safety, or property of its business, employees, suppliers, customers, or others; to enforce the terms of any agreement with V5; to combat fraud or other criminal activity, as otherwise required or permitted by law, or with your consent. V5 will not share, sell, trade, or lease your information to or with others except as provided for in this Privacy Policy.

Certain V5 products contain features that permit file or data sharing or synchronization with other users or V5 products. If use these features, you acknowledge and agree that (i) you consent to the disclosure of the transferred information to the recipient, (ii) the transfer (and the transferred information) is in compliance with all of the terms and conditions of the V5 Software and Data, (iii) V5 is not responsible for the transferred content or for the complete, accurate or error-free transfer itself.

Your Marketing Choices and Our Retention of Your Personal Information

Your Marketing Choices. Your decision to provide the personal information that we may request from time to time is voluntary. However, if you do not provide the information requested, you may not be able to proceed with the activity or receive the benefit for which the information is being requested.

Limitation of Retention of Your Information. Upon termination or expiration of any applicable agreement, V5 will allow you to access and retrieve your video and Data for a limited time period prior to deletion and/or purging of all your Data by V5. V5 maintains the right to retain any Data or information that is or is reasonably likely to be disclosed in order to comply with any regulatory, local, state or federal laws, court orders, and all other legal obligations.

Security of Your Information

V5 strictly protects the security of your personal information and honors your choice for its intended use. V5 has implemented reasonable administrative, technical, and physical measures designed to secure, safeguard and protect your Data and information, from unauthorized access, disclosure, use, alteration, or destruction. All data transfers and administrative access is in an encrypted format and each device uses a proprietary encryption which includes 2K RSA keys (2048 bits) with overall encryption using AES 256 (256 bit keys) with randomized public and private keys.

Your California Privacy Rights

Any California residents under the age of eighteen (18) who have posted content or information on the for or on behalf of V5 can request disclosure of your personal information or removal by sending an e-mail to info@v5systems.us or by letter to V5 Systems, Inc. 47061 Warm Springs Blvd., Fremont, CA 94539 (Attn: Legal Dept.), with information detailing where the content or information is posted. Please include “California Privacy Rights” in the subject line of your e-mail or letter with your first name, last name, mailing address, email address, and telephone number. We will make reasonable good faith efforts to remove the post from prospective public view or anonymize it so a minor cannot be individually identified. This removal process cannot ensure complete or comprehensive removal.

Social Media and Refer a Friend

Our websites or applications may include social media features, such as the Facebook “Like” button, and widgets, such as the “share this” button. These features may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on our websites or applications. Your interactions with these features are governed by the privacy policy of the company providing them. V5 does not store this information, except to the extent permitted by law.

Children Under the Age of 13

V5’s websites and applications are not intended for children under 13 years of age. No one under age 13 may provide any personal information to or on our websites or applications. We do not knowingly collect personal information from children under 13 and, if we learn that we have received information from a user under the age of 13, we will delete this information in accordance with the Children’s Online Privacy Protection Act (“COPPA”). If you are a child under the age of thirteen (13), do not use or provide any information on V5’s website or application, or on or through any of its features, register on the website or application, make any purchases through the website or application, use any of the interactive or public comment features of this website or application, or provide any information about yourself to us, including your name, address, telephone number, email address or any screen name or user name you may use.
